Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the LocalTuneUp website and Pay-Per-Lead services operated by LocalTuneUp ("us", "we", or "our").

1. Acceptance of Terms

By accessing our website or purchasing our services (including the "Starter Credit"), you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service (The "Hybrid Model")

LocalTuneUp provides a hybrid local marketing service that includes:

• Management and optimization of your Google Business Profile (GBP).
• Access to our proprietary Ranking Dashboard.
• Exclusive Lead Generation via tracking numbers placed on your digital assets.

3. Billing, Credits, and Refunds

3.1 The Credit System

Our service operates on a prepaid credit basis. You purchase a credit block (e.g., $500), and funds are deducted from this balance for each "Qualified Lead" generated.

3.2 Definition of a Qualified Lead

A "Qualified Lead" is defined as a phone call that meets ALL the following criteria:

• Duration: Lasts longer than 60 seconds.
• Location: Originates from your designated service area.
• Intent: Is a potential customer seeking services you offer (not a solicitor, wrong number, or employee call).

3.3 Refund Policy

Spam Leads: We automatically filter most spam. If a spam call slips through and you are charged, you have 7 days to dispute it via your dashboard. We will review the call recording and issue a 100% credit back to your account balance if it was invalid.

Account Cancellation: If you choose to cancel our service, your remaining unused credit balance is fully refundable. Refunds are processed within 5-10 business days to the original payment method.

4. Exclusivity Policy

We strictly partner with one business per industry per primary Zip Code. "Primary Zip Code" is defined as the physical address used to verify your Google Business Profile.

While we may generate leads from surrounding areas, we guarantee that we will not manage a direct competitor's Google Business Profile located within your claimed Zip Code while your account is active and in good standing.

5. Call Recording & Compliance

To verify lead quality and dispute spam, all calls flowing through our tracking numbers are recorded.

• Consent: By using our service, you consent to these recordings.
• Notification: Our system may play a whisper message or audible beep to notify callers they are being recorded, in compliance with US One-Party and Two-Party consent laws.
• HIPAA/Privacy: If you are a medical or legal provider, you agree that you are solely responsible for handling patient/client data in compliance with HIPAA and relevant privacy laws.

6. Limitation of Liability

LocalTuneUp is a third-party agency. We do not own Google, Bing, or Apple Maps.

• We cannot guarantee specific ranking positions (e.g., "#1 forever") as algorithms change constantly.
• We are not liable for any account suspensions imposed by Google due to your prior business history or violation of Google's Terms of Service.
• In no event shall LocalTuneUp be liable for any indirect, incidental, or consequential damages resulting from the use of our services.

7. Termination

You may cancel your account at any time by emailing support@localtuneup.com. Upon cancellation, all tracking numbers will be released, and any remaining credit balance will be refunded.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of [YOUR STATE], United States, without regard to its conflict of law provisions.
